TERMS & CONDITIONS OF SALE

This agreement sets out the terms and conditions that will govern the relationship between us, HBA (HB Acting) and you, the Parent/Guardian, customer/client, user/vistor. It is a legally binding agreement. These conditions are important to maintain standards and to ensure that all members gain the maximum benefit from their membership.

By enrolling your child at HBA (HB Acting), you accept these terms and conditions (“Terms & Conditions”) and sign your agreement to them as an ongoing agreement between you and HBA (HB Acting) (“Agreement”).

The Agreement is made between the parent/guardian (“Parent”, “you” or “your”) of each enrolled student (“Student”) by a Parent and HBA (HB Acting) (“HBA (HB Acting)”, “we”, “our”, “us”) (trading as HBA) and is valid at all times whilst the Student is enrolled on any HBA (HB Acting) activity and until such time as written notice is given in accordance with these Terms & Conditions.

 

  1. INTRODUCTION

1.1                      These Terms & Conditions apply to all our HBA (HB Acting) schools, Courses, Holiday Workshops/Camps, Workshops and any additional products and/or services offered by HBA (HB Acting) and/or its group of companies in the future for any Student (collectively “HBA (HB Acting) Activities”)

1.2                      For participation of a Student in a HBA (HB Acting) Activity all Parents are required to consent to these Terms & Conditions by signature or by ticking the acceptance box for these Terms & Conditions when submitting an electronic form and payment online. We may update these Terms & Conditions from time to time.

1.3                      If you are an existing Parent of HBA (HB Acting) please read these amended Terms & Conditions carefully. Unless you contact us within fourteen (14) calendar days of receipt of these new Terms & Conditions, they shall supersede and extinguish all previous agreements between us and shall govern the contractual relationship between us going forwards. Your continued enrolment of a Student in HBA (HB Acting) Activities shall be deemed as acceptance of these Terms & Conditions and willingness to be bound by the same.

1.4                      Any changes to these Terms & Conditions require the written consent or approval of HBA (HB Acting).

1.5                      A “Course” refers to a course of classes offering tuition in acting, drama, LAMDA and performance which will be delivered during the Term. Course classes will take place once per week for a certain number of hours, as detailed at the time of booking.

1.6                      “Holiday Workshop/Camp” refers to Workshops run by HBA (HB Acting) during the breaks between Terms.

1.7                      “Term” refers to one normal academic term during which Courses are run.

1.8                      “Term Dates” refers to the dates for the relevant Term.

1.9                      “Workshop” refers to a one-off course offering tuition in acting, dance, drama, performance, singing and/or other performing arts related activities which will be delivered for a certain number of hours per day for a period of between one (1) and five (5) consecutive days and can run at any time throughout the year.

 

  1. Fees and Payment

2.1                       Any free trial (taster session) is strictly at the approval of HBA (HB Acting), subject to availability and does not guarantee a place on a HBA course, workshop, session, project. A free trial may not be claimed in retrospect.

2.2                       Fees are divided into tuition fees (inc. VAT where applicable) and exam fees (inc. VAT where applicable). VAT invoices are available on request. Discounted fees will vary. Class timetables, teachers are subject to change from time to time without notice.

2.3                       For our weekly LAMDA Acting lessons, the minimum period is a term. You must pay the term fees either on our website www.hbacting.co.uk, by bank transfer or by Direct Debit for the minimum period unless your child’s involvement is terminated without liability, suspended or transferred in accordance with these terms.

2.4                       We will suspend fees during the minimum period in the event that the child is unable to attend for more than one month due to his / her injury or illness. In the unfortunate event that it is medically no longer possible for the child to attend any HBA (HB Acting) classes, lessons, sessions, courses, workshops or projects, we will cancel the minimum membership period without any further obligation to you.

2.5                       Payment is due in advanced of each term. Payment must be made directly on our website www.hbacting.co.uk by bank transfer or by Direct Debit mandate if pre-agreed. If payment of tuition fees is not made in full for any reason we reserve the right to suspend or exclude your child from HBA (HB Acting) classes, lessons, sessions, courses, workshops or projects.

2.6                       In the event that you do not make the fee payments when due, the right to send the child to attend any HBA (HB Acting) classes, lessons, sessions, courses, workshops or projects will be withdrawn until payment is received and brought up to date.

2.7                       In the event that a Student is unable to attend a HBA (HB Acting) Activity session, due to sickness, holiday or a decision by the Parent or Student not to attend, HBA (HB Acting) regrets that it is unable to refund any payment.

2.8                       A four week notice period is required for termination of tuition and can only be given in writing via email to [email protected] or by text message (please confirm receipt). The time of receipt (not sending) shall be the time of commencement of the notice period.

 

  1. Conduct

3.1                       In order to avoid disturbing classes, you and your child are requested to arrive in good time. Entrance to classes may be barred to anyone arriving more than 15 minutes late.

3.2                       A teacher may, at any time, ask your child to leave a class if he/she is jeopardising the safety or enjoyment of others or their educational experience.

3.3                       Each class, course, workshop or project may also have its own additional rules of which you will be notified. Yourself, your child and any guests are required to observe these rules in full.

3.4                       Bullying, harassment, abuse or other inappropriate behaviour by you, your child or guests is strictly forbidden and will result in expulsion and such other legal remedies as may be available.

3.5                       You and your child must treat all HBA members, children, staff and teachers with respect and consideration. HBA does not tolerate rude, offensive or aggressive remarks and behaviour in any way. You must make yourself and your child aware of the health and safety rules of the venue and comply with the recommendations at all times.

3.7                       Smoking and the bringing or consumption of alcohol and the use or being under the influence of illegal substances is not permitted.

3.8                       We may discontinue the child’s entitlement to attend the classes, lessons, sessions, courses, workshops or projects in the event of serious or repeated breach of these rules.

 

  1. HEALTH AND INJURIES

4.1                      Students participate at their own risk and are obliged to inform HBA (HB Acting) and its staff of any existing injuries or medical condition. All application forms must have any known medical conditions stated and any changes to such information must be notified to HBA (HB Acting) immediately in writing.

4.2                      If you are unsure whether a Student should participate in any activity please consult the Student’s GP before enrolling the Student on a HBA (HB Acting) Activity.

4.3                      Any medication left on the school premises must be clearly labelled and the Student should, unless HBA (HB Acting) has agreed in writing otherwise, be able to administer it themselves.

4.4                      Students must wear suitable footwear and clothing at all times, including HBA (HB Acting) uniform for all Courses.

4.5                      If a Student is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the emergency contact details provided below or on the enrolment form. This number must always be contactable whilst the Student is attending the HBA (HB Acting) Activity.

4.6                      Parents are solely responsible for ensuring that the emergency contact details on HBA (HB Acting)’s records are up to date.

 

  1. PERSONAL PROPERTY

5.1                      Students are obliged to take care of their own belongings. HBA (HB Acting) can accept no liability for lost or damaged belongings.

5.2                      You acknowledge that the maximum aggregate liability of HBA (HB Acting) to a Student or Parent under these Terms & Conditions shall not exceed the HBA (HB Acting) Activity fee to which a claim relates.

5.3                      The liability of HBA (HB Acting) and that of its staff is restricted to class time only and then only to gross negligence.

 

  1. GENERAL

6.1                      HBA (HB Acting) may, at its own discretion, refuse a Student entry to a HBA (HB Acting) Activity or session of a HBA (HB Acting) Activity if it is felt that the Student’s behaviour is unacceptable.

6.2                      HBA (HB Acting) reserves the right to make changes to the timetable and to the teaching staff from the advertised programme in the event of illness or other circumstances beyond our control.

6.3                      Where a session of a HBA (HB Acting) Activity has to be cancelled by HBA (HB Acting), HBA will give as much notice as possible. In the event of a last minute session cancellation, you will be notified by email, text message, a call to your mobile phone or through a designated HBA (HB Acting) social media site. Parents must ensure that they provide HBA with up-to-date contact details.

6.4                      It is occasionally necessary to change the time and/or venue of a HBA (HB Acting) Activity session. This will only be done if absolutely necessary and HBA (HB Acting) will do its best to keep class times and locations as similar as possible but unfortunately this cannot always be guaranteed.

6.5                       HBA (HB Acting) reserves the right to change the day, time and location of the classes, sessions, workshop, performances and projects. Should this be restrictive to attendance the minimum notice period can be waived at the discretion of HBA (HB Acting) and it’s representatives.

6.6                       These Terms & Conditions, together with any Fee Note, Acceptance Letter, order confirmation and/or Venue Sheet, constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

6.7                      In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.

6.8                       This agreement may be terminated if either party is in serious breach of its obligations to the other.

6.9                       We reserve the right to make changes to these rules.

6.10                    The Agreement shall be governed by, and construed in accordance with, the laws of England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of the English courts.
